1. PARTIES

This Agreement is concluded between the following parties under the terms and conditions stated below.

By accepting this agreement, the BUYER acknowledges in advance that, upon approving the order subject to the agreement, the BUYER assumes the obligation to pay the order amount and any additional fees stated such as shipping and taxes, and has been informed accordingly.

2. DEFINITIONS

In the application and interpretation of this agreement, the following terms shall have the meanings written opposite them.

  • MINISTER: The Minister of Customs and Trade,
  • MINISTRY: The Ministry of Customs and Trade,
  • LAW: Law No. 6502 on Consumer Protection,
  • REGULATION: The Distance Contracts Regulation,
  • SERVICE: Any consumer transaction other than the supply of goods that is performed or undertaken to be performed in return for a fee or benefit,
  • SELLER: The company that offers goods to the consumer within the scope of its commercial or professional activities, or acts on behalf or for the account of the supplier,
  • BUYER: The natural or legal person who acquires, uses, or benefits from a good or service for non-commercial or non-professional purposes,
  • SITE: The website belonging to the SELLER,
  • ORDERING PARTY: The natural or legal person who requests a good or service through the SELLER’s website,
  • PARTIES: The SELLER and the BUYER,
  • AGREEMENT: This agreement concluded between the SELLER and the BUYER,
  • GOODS: Movable items subject to shopping and intangible goods such as software, audio, video and similar items prepared for use in electronic environment,

3. SUBJECT

This Agreement regulates the rights and obligations of the parties regarding the sale and delivery of the product whose characteristics and sale price are stated below, ordered electronically by the BUYER through the SELLER’s website, in accordance with Law No. 6502 on Consumer Protection and the Distance Contracts Regulation.

The prices listed and announced on the site are sale prices. Announced prices and promises remain valid until updated or changed. Prices announced for a limited period remain valid until the end of the stated period.

7. INFORMATION ON THE PRODUCT(S) SUBJECT TO THE AGREEMENT

1. The basic characteristics of the goods/product(s)/service (type, quantity, brand/model, color, number) are published on the SELLER’s website. If a campaign has been organized by the Seller, you may review the basic characteristics of the relevant product during the campaign period.

7.2. Prices

The prices listed and announced on the site are sale prices. Announced prices and promises remain valid until updated or changed. Prices announced for a limited period remain valid until the end of the stated period.

7.3. Taxes and Payments

The sale price of the goods or service subject to the agreement, including all taxes, is shown below.

Invoice delivery: The invoice will be delivered together with the order to the invoice address during order delivery.

9. GENERAL PROVISIONS

9.1. Information and Acceptance

The BUYER accepts, declares, and undertakes that they have read and been informed of the preliminary information regarding the basic characteristics, sale price, payment method, and delivery of the product subject to the agreement on the SELLER’s website, and have given the required confirmation electronically.

9.2. Delivery Period

Each product subject to the agreement shall be delivered within the period stated in the preliminary information section of the website, depending on the distance of the BUYER’s place of residence, without exceeding the legal period of 30 days.

10. RIGHT OF WITHDRAWAL

Where the distance contract relates to the sale of goods, the BUYER may exercise the right of withdrawal within 14 days from the date the product is delivered to the BUYER or to the person/organization at the indicated address, by notifying the SELLER, without stating any reason.

11. PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED

Products prepared in line with the BUYER’s request or clearly personal needs, underwear bottoms, cosmetics, disposable products, and similar items are excluded from the scope of the right of withdrawal.

12. DEFAULT AND LEGAL CONSEQUENCES

If the BUYER defaults when paying by credit card, the BUYER accepts, declares, and undertakes to pay interest under the credit card agreement with the card-issuing bank and to be liable to the bank.

13. COMPETENT COURT

For disputes arising from this agreement, complaints and objections shall be made to the consumer arbitration committee or consumer court in the place of the consumer’s residence or where the consumer transaction was made.

14. ENTRY INTO FORCE

When the BUYER completes payment for the order placed through the Site, the BUYER shall be deemed to have accepted all terms of this agreement.
