CONSUMER RIGHTS – WITHDRAWAL – CANCELLATION AND RETURN TERMS

GENERAL:

1. By placing an order electronically through this website, you are deemed to have accepted the pre-information form and the distance selling agreement presented to you.

2. Buyers are subject to Law No. 6502 on Consumer Protection, the Distance Contracts Regulation (OG: 27.11.2014/29188), and other applicable laws regarding the sale and delivery of purchased products.

3. Shipping fees for product delivery shall be paid by the buyers.

4. Each purchased product shall be delivered to the person and/or organization at the address indicated by the buyer within a maximum of 30 days as required by law. If the product is not delivered within this period, the Buyer may terminate the contract.

5. The purchased product must be delivered complete, in accordance with the specifications stated in the order, and together with any warranty certificate, user manual, or similar documents if applicable.

6. If sale of the purchased product becomes impossible, the seller must notify the buyer in writing within 3 days of becoming aware of this situation. The total amount must be refunded to the Buyer within 14 days.

IF THE PURCHASE PRICE IS NOT PAID:

7. If the Buyer does not pay for the purchased product or cancels the payment in bank records, the Seller’s obligation to deliver the product ends.

PURCHASES MADE WITH UNAUTHORIZED USE OF A CREDIT CARD:

8. If, after delivery, it is determined that the credit card used by the buyer was used unlawfully by unauthorized persons and the product price is not paid to the Seller by the relevant bank or financial institution, the Buyer must return the product to the SELLER within 3 days, with shipping costs borne by the SELLER.

IF THE PRODUCT CANNOT BE DELIVERED ON TIME DUE TO UNFORESEEN REASONS:

9. If force majeure events unforeseeable by the Seller occur and the product cannot be delivered on time, the Buyer shall be notified. The Buyer may request cancellation of the order, replacement with a similar product, or postponement of delivery until the obstacle is removed. If the Buyer cancels and paid in cash, the amount shall be refunded in cash within 14 days. If payment was made by credit card, the product price shall be refunded to the bank within 14 days; the bank may take 2–3 weeks to credit the Buyer’s account.

BUYER’S OBLIGATION TO INSPECT THE PRODUCT:

10. Before taking delivery of the goods/services under the contract, the Buyer shall inspect them and shall not accept damaged or defective goods/services (crushed, broken, torn packaging, etc.) from the courier. Goods/services accepted for delivery shall be deemed undamaged and intact. After delivery, the BUYER must carefully preserve the goods/services. If the right of withdrawal will be used, the goods/services must not be used. The invoice must also be returned with the product.

RIGHT OF WITHDRAWAL:

11. The BUYER may exercise the right of withdrawal within 14 (fourteen) days from the date the product is delivered to the BUYER or to the person/organization at the indicated address, by notifying the SELLER via the contact details below, without assuming any legal or criminal liability and without stating any reason.

13. If the purchase is a service, this 14-day period starts from the date the contract is signed. The right of withdrawal cannot be exercised for service contracts where performance has begun with the consumer’s approval before the withdrawal period ends.

14. Costs arising from the exercise of the right of withdrawal belong to the SELLER.

15. To exercise the right of withdrawal, written notice must be given to the SELLER within 14 (fourteen) days by registered mail with return receipt, fax, or email, and the product must not have been used in accordance with the “Products for Which the Right of Withdrawal Cannot Be Exercised” provisions of this agreement.

EXERCISING THE RIGHT OF WITHDRAWAL:

16. The invoice of the product delivered to a third party or to the BUYER (If the invoice of the product to be returned is corporate, a return invoice issued by the institution must also be sent. Returns of orders invoiced to institutions cannot be completed unless a RETURN INVOICE is issued.)

17. The return form and the products to be returned must be delivered complete and undamaged together with their box, packaging, and any standard accessories.

RETURN CONDITIONS:

18. The SELLER is obliged to refund the total amount and any documents that put the BUYER under debt within a maximum of 10 days from receipt of the withdrawal notice, and to take back the goods within 20 days.

19. If the value of the goods decreases or return becomes impossible due to the BUYER’s fault, the BUYER shall compensate the SELLER’s damages in proportion to the fault. However, the BUYER is not responsible for changes or deterioration caused by proper use of the goods or product during the withdrawal period.

20. If exercising the right of withdrawal causes the campaign limit amount arranged by the SELLER to fall below the threshold, the discount amount benefited under the campaign shall be cancelled.

PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED:

21. In accordance with the Regulation, returns are not possible for goods prepared in line with the BUYER’s request or clearly personal needs and not suitable for return; underwear bottoms, swimsuit and bikini bottoms; cosmetics; disposable products; goods liable to deteriorate quickly or whose expiry date may pass; products that are unsuitable for return for health and hygiene reasons once the packaging is opened by the BUYER after delivery; products that mix with other products after delivery and cannot be separated by nature; periodicals such as newspapers and magazines (except those provided under a subscription contract); services performed instantly in electronic environment or intangible goods delivered instantly to the consumer; and sound or image recordings, books, digital content, software programs, data recording and storage devices, and computer consumables if their packaging has been opened by the BUYER. Likewise, the right of withdrawal cannot be exercised for services whose performance has begun with the consumer’s approval before the withdrawal period ends.

22. Cosmetics and personal care products, underwear, swimsuits, bikinis, books, copyable software and programs, DVDs, VCDs, CDs and cassettes, and stationery consumables (toner, cartridge, ribbon, etc.) may only be returned if their packaging is unopened, untried, undamaged, and unused.

DEFAULT AND LEGAL CONSEQUENCES

23. If the BUYER defaults when paying by credit card, the BUYER accepts, declares, and undertakes to pay interest under the credit card agreement with the card-issuing bank and to be liable to the bank. In such case, the relevant bank may pursue legal remedies; claim costs and attorney fees from the BUYER; and in any event, if the BUYER defaults on the debt, the BUYER accepts to pay the damages suffered by the SELLER due to delayed performance.

24. You may pay by bank transfer or EFT (Electronic Funds Transfer) to any of our bank accounts (TRY).

25. Through our site, you may use online single payment or online installment options with any credit card. For online payments, the amount will be charged from your credit card at the end of your order.
